Representation, booking terms and payment conditions
Aptenex Limited, hereinafter called AL, owns and operates a network of internet platforms, hereinafter called ”the websites”, for the reservation of accommodation.
AL solely acts as an authorized representation agent for the person or companies providing accommodation and related services, hereinafter called “Accommodation Suppliers” and all vouchers or other representation documents follow the Accommodation Suppliers terms and conditions.
All bookings made via the websites are bound to the following terms and conditions. Considering the nature of payment being related to accommodation, it is required to have read and understood these terms and conditions prior to any payment being made and a reservation is confirmed.
Representation of private properties
1- Suitability of the properties
AL does not claim that any of the private properties or service set out in our websites is suitable for you or your guests. The person executing the payment releases AL from any claims in relation to the suitability of the private properties and services described in the websites, including claims that the products or services are not suitable in either of their design, location or facilities and services provided.
You are entitled to ask all information and details specific to a property, its suitability and location prior to the payment of rental funds. Such payment is your consent that the property is suitable and as per your expectations in regards to its suitability and location.
2- Property description and photos
Photographs, description, illustrations and other promotional material are for promotion purposes only and are exclusively presented and updated by the Accommodation Suppliers.
The websites' content is subject to change without notice before or during your stay. AL has endeavoured to ensure that all information in the websites is accurate, but can accept no responsibility for inaccuracy, or truth of statements made.
AL makes every effort to ensure all information displayed in the websites is accurate; however, as considerable information is updated by the Accommodation Suppliers, we are unable to guarantee the accuracy of all information nor are we able to guarantee that the websites are free of errors or faults in its content. We reserve the right to change any information displayed on the websites (including these terms and conditions) at any time without notice to you.
3- Fair representation
It is the sole responsibility of the Accommodation Suppliers to keep the information accurate and updated to render the property as clearly and fairly represented as possible.
AL can’t be held responsible for a misrepresentation or outdated information as provided by the Accommodation Suppliers.
4- Data Copyright
Images and content on the websites are copyright of either AL or the Accommodation Suppliers.
Rates and Reservation
1- Rates availability
Rates quoted on the websites may or may not be inclusive of taxes and service charges. All details will be provided by the Accommodation Suppliers in their formal quotation to you.
The rates offered by the Accommodation Suppliers are only available when you wish to confirm your booking in advance via the Internet by paying a deposit.
2- Reservation Confirmation
Reservations are confirmed once the receipt of a deposit or full amount is confirmed as per the amount required by the Accommodation Suppliers.
As a confirmation, you may receive a Booking Confirmation & Voucher email. This email will need to be presented to the Accommodation Suppliers upon check-in.
At the time of the enquiry you must ensure that your email address is correct and reachable at all times. If you do not receive any email from our system within 24 hours, please contact us immediately.
Making payment through to the Accommodation Suppliers or through AL online payment gateway is regarded as your firm confirmation of arrival. Should you fail to fulfil your arrival, and regardless of the circumstances, the cancellation and no-show policy will be applied as indicated herein or as per the Accommodation Suppliers terms and conditions, whichever is indicated to you by the Accommodation Suppliers.
Likewise, should you fail to cancel within the cancellation period, the Accommodation Suppliers reserve the right to request and apply the full cancellation policy and the applicable penalty as stated by the Accommodation Suppliers in their proposal to you or in the websites.
3- Check-In/Out Time
The Check In and Out Times may vary from one property to another. It is best to receive confirmation of the Accommodation Suppliers prior to securing your reservation with a payment. Early arrival and late departure will depend upon the availability of the properties at the time of arrival or departure and are at the sole discretion of the Accommodation Suppliers. You are responsible for informing the correct arrival details (flight number is recommended) to the Accommodation Suppliers once the booking is confirmed or at your earliest possible time.
Payment of reservation using bank transfer
You may be asked by the Accommodation Suppliers or AL to transfer the rental funds to either a company or personal bank account as per the terms agreed with the Accommodation Suppliers. Such payments must be made free of any international bank fees (both from the sending and intermediary banks).
Payment of reservation using a Credit Card
You may require a valid credit card to pay for your reservation. You agree for your card to be charged for either a deposit, a balance or the full amount due for your stay including any other services as detailed in the offer conditions you received from the Accommodation Suppliers.
A non-refundable Admin fee may be charged for each payment.
The charge is to be applied in US Dollars (USD) unless otherwise stated during the reservation process.
The Accommodation Suppliers may also ask for a valid credit card again upon check-in. This is to cover incidental expenses like meals, drinks, laundry, etc. You will remain responsible for payment of all such extra charges directly to the Accommodation Suppliers.
5- Changes in the Rates offered by the Accommodation Suppliers
The rates and other benefits as specified by the Accommodation Suppliers to you are contractual between you and the Accommodation Suppliers once a payment for a reservation has been processed.
Should the Accommodation Suppliers wish to change any of the details, such changes are not applicable when a payment is confirmed.
After the booking is confirmed
The possibility to apply amendments to your reservation, including but not limited to changing the dates of arrival or departure or the number of guests, is dependent on the Accommodation Suppliers policy which you should request and have to agree with prior to making any payment.
If there are any changes to your reservation including extension, reduction of stay or delayed arrival, you MUST contact AL and the Accommodation Suppliers at your earliest possible time to advise of such changes.
Failing to advise any changes to AL and/or the Accommodation Suppliers may be considered as partial cancellation which will be subject to the Accommodation Suppliers or AL policy.
2- Shortening of stay
The shortening of stay, including but not limited to early check-outs, reduction or increase in the number of guests staying may be considered as partial cancellation which will be subject to the Accommodation Suppliers and/or AL policy.
3- Extending your stay
You can extend your stay by making the request through the websites.
Please note that it is best for all extension of stay to be made at least 24 hours prior to the check out date.
4- Due care and supervision
As part of this agreement, you are required to take due care when residing at the properties and be especially watchful of children playing in the gardens, near the entrance from the main road; and when near or in the pool or Jacuzzi, on the beach, or in the sea.
Furthermore, Guests are not permitted to enter a property when wet from swimming as the floors can be slippery. Damage or injury arising, as a result, shall not be the responsibility of AL, the Accommodation Suppliers in any way whatsoever.
For all reservations where the registered guests are under 21 years old, a security deposit may be required along with prior notification before the confirmation of the booking. If notification of ages is not made upon confirmation of the reservation, then AL and/or the Accommodation Suppliers retains the right to cancel the booking upon your arrival with NO refund.
AL operates a network of booking platforms for accommodation. You should only use it when you are sure that you are able to use the accommodation on the dates you have chosen and that you have a confirmed flight for yourself and all guests staying with you.
By processing the payment for your reservation, you are in agreement that:
- processing a booking with certain Accommodation Suppliers, or at certain time(s) of the year, or for certain accommodation type(s) cannot be cancelled or changed.
- some Accommodation Suppliers may permit cancellations or changes but this may involve the Accommodation Suppliers imposing a charge. Such charge must be informed to you and if not you must request the cancellation policy prior to making any payment either with AL online payment gateway or to the Accommodation Suppliers.
Executing a payment, either using an online payment gateway or bank transfer, with AL and/or directly to the Accommodation Suppliers is considered as your agreement on such charges, whether you have received them from the Accommodation Suppliers or not.
2- Cancellation Fees
In general, any cancellation will incur a minimum of 1-night cancellation charge as per the Accommodation Suppliers policy but may be extended to the full amount paid.
In case a refund is possible as per the Accommodation Suppliers agreement and policy, the amount due to be paid back to you may be credited to your credit card or via bank transfer to any denominated account of your choice. All banks fee related to any possible refund will be at your charge.
The admin fee which may have been charged with each payment made through an online payment gateway is non-refundable.
3- Contact Customer Service Centre
If you want to change any details of your booking, you must contact our Villa Specialists. We will do our best to assist you, but cannot guarantee that changes can be made as per the Accommodation Suppliers policy.
4- No show and failing to cancel a booking
If you fail to cancel a booking and do not check-in in accordance with the booking made and paid for, the Accommodation Suppliers may be expecting to charge a cancellation fee up to the full amount of the booking made as per the offer you have received.
The admin fee which may have been charged with each payment made through an online payment gateway is non-refundable.
5- Travel Insurance
It is a mandatory condition of your booking that the entire party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage).
AL or the Accommodation Suppliers are held harmless by you and your party against all claims including any accidents related to the use of the property facilities or locally procured third party services such as, but not limited to, tours, activities, watercraft, water sports, motorbike rental, car rental with and without a driver.
AL and the Accommodation Suppliers shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside of AL and the Accommodation Suppliers’s control such as civil disturbances, riots, fires, floods, severe weather, Acts of God, Acts of Government, accidents to or failure of machinery, equipment, vehicles or industrial disputes etc.
By acceptance of these terms, it is assumed by AL and the Accommodation Suppliers that this requirement has and will be complied with in full.
Responsibility for Aptenex Ltd
1- General Principle
AL solely acts as an authorized representation agent for the Accommodation Suppliers.
Without affecting any of your statutory rights which cannot be lawfully excluded, AL will not be liable for any losses, damages, liability, claims or expenses (whatsoever and irrespective of whether direct, indirect, consequential) arising from the use of or connected with the websites or any products or services purchased on the websites.
We make no warranty or representation as to the fitness or suitability of any property or service displayed on our websites.
2- Property differences in style and décor
Each property varies in standard, quality and finish and there are differences in style and decor. Property descriptions as solely provided by the Accommodation Suppliers, on the websites and elsewhere, are made in good faith.
AL shall not be liable for, or responsible to, any customer in the event of dissatisfaction based on personal opinion regarding the standard of service or accommodation provided by any local service provider nor be liable or responsible for any disappointment, distress, lack of enjoyment arising from any act or omission whatsoever.
AL can not be held accountable for any modifications made which are not mentioned on the websites or anywhere else.
3- Disruption in facilities and supply of services
AL and the Accommodation Suppliers cannot be held liable for the breakdown of the supply of water, or electricity, or internet connection nor of swimming pool filtration systems, or the sudden start of a construction of a nearby project during your stay at the property, though the Accommodation Suppliers will use their best endeavours to arrange for any such problems to be solved quickly and informed to you.
4- Unavailability of accommodation
AL represents accommodation from an inventory supplied and solely updated by each Accommodation Supplier.
AL does not over-sell such inventory and therefore cannot accept liability for unavailability of properties caused by an Accommodation Suppliers over-selling its own inventory or failing to update the availability in the websites.
5- AL support
If there are any problems during the rental period, which could not be solved by dealing directly with the Accommodation Suppliers, you may contact AL’s Villa Specialists and AL will use its best endeavours to rectify the situation to its best means.
It is understood that infrastructure, local standards and conditions are often of a less developed nature in a remote resort location than in more urban environments. AL will do as much as can be reasonably expected to avoid and rectify any problems that may occur, but cannot be held responsible for any problems beyond its control.
6- Notification period
Any complaints must be notified to AL or the Accommodation Suppliers within 24 hours of the occurrence giving rise to the complaint, and prior to departure from the property, as well as certified correct by a local representative of the Accommodation Suppliers.
Should a problem that has been notified remain unsolved please make a complaint in writing to AL and the Accommodation Suppliers within 14 days of the completion of the rental period.
If the property is vacated before the end of the rental period without a mutual agreement with the Accommodation Suppliers this may result in the loss of all rights to compensation.
No complaint whatsoever will be considered when made after the departure date or if not acknowledged by AL or the Accommodation Suppliers during the period of stay in the property.
AL cannot be held responsible for any circumstances leading to a complaint, whether the complaints have been duly resolved by the Accommodation Suppliers or left unattended.
These conditions and any contract to which they apply are governed in all respects by the law of the United Kingdom and such courts only shall have jurisdiction in relation to any claim or dispute arising out of, or connected with them.
